1. Parties and definitions
GrowBusiness.ai (the "Service", "Platform", "we", "us", "our") is a trademark and product of Ai Powerhouse Swiss AG ("SWISS.Ai"), a Swiss corporation registered at Gotthardstrasse 18, 6300 Zug, Switzerland. The Service is operated in partnership with operating partner HAZEL LABS d.o.o., Litostrojska cesta 42B, 1000 Ljubljana, Slovenia, VAT ID SI33997250.
"User", "you", or "your" refers to any individual or legal entity accessing or using the Service. "Agreement" means these Terms & Conditions together with our Privacy Policy and Cookie Policy.
2. Acceptance of terms
By creating an account, accessing, or using the Service in any way, you confirm that you have read, understood, and agree to be bound by this Agreement. If you do not agree, you must not use the Service.
3. Eligibility
You must be at least 18 years old and capable of entering into a binding legal agreement under the laws applicable to you. If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to this Agreement.
4. Description of the Service
GrowBusiness.ai is a multi-agent artificial intelligence platform that orchestrates specialized AI agents (covering strategy, design, development, marketing, sales, operations, support, and research) to assist solo entrepreneurs and small teams in operating a business. Outputs include but are not limited to text, code, images, plans, emails, and automated workflow execution.
5. Accounts and security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use. We may suspend or terminate accounts that show signs of abuse, fraud, or violation of this Agreement.
6. Subscriptions, credits, and billing
The Service is offered on subscription plans and a credit-based usage model. A "credit" represents one unit of agent work. Plan changes take effect immediately and are billed pro-rata. All prices are exclusive of applicable VAT or other taxes, which will be added where required.
Payments are processed by third-party payment providers. You authorize recurring charges to your payment method until you cancel. Cancellation takes effect at the end of the current billing period. Credit balances are non-refundable and non-transferable.
7. Acceptable use
You agree not to use the Service to:
- Violate any applicable law, regulation, or third-party right.
- Generate or distribute illegal, defamatory, hateful, harassing, or sexually explicit content involving minors.
- Attempt to reverse-engineer, extract model weights from, or otherwise compromise the integrity of the Service.
- Send spam, unsolicited bulk communications, or run deceptive marketing campaigns.
- Infringe intellectual property rights of others.
- Use the Service to develop a competing AI orchestration product.
We may suspend access without notice if we reasonably believe you are violating this section.
8. Your content and AI outputs
You retain ownership of the inputs you submit ("User Content"). To the extent permitted by law, you also own the outputs generated for you by the agents ("Outputs"), subject to the limitations of underlying third-party model licenses. You are solely responsible for reviewing Outputs before relying on them. AI Outputs may contain errors, omissions, or hallucinated facts.
You grant SWISS.Ai a worldwide, non-exclusive, royalty-free license to process User Content and Outputs strictly as needed to operate, secure, and improve the Service.
9. Intellectual property
The Service, including the SWISS.Ai orchestration engine, the GrowBusiness.ai brand, logos, UI, and documentation, are and remain the exclusive property of Ai Powerhouse Swiss AG. No rights are granted other than the limited license to use the Service under this Agreement.
10. Third-party services and integrations
The Service integrates with third-party platforms (e.g. Stripe, GitHub, Google, Slack, messaging providers). Your use of those services is governed by their respective terms. We are not responsible for third-party outages, errors, or policy changes.
11. Disclaimers
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.
12. Limitation of liability
To the maximum extent permitted by law, SWISS.Ai, HAZEL LABS d.o.o., and their respective officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our aggregate liability for any claim shall not exceed the fees you paid to us in the twelve (12) months preceding the event giving rise to the claim.
13. Indemnification
You agree to defend, indemnify, and hold harmless SWISS.Ai and HAZEL LABS d.o.o. from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your User Content, your Outputs, or your breach of this Agreement.
14. Termination
You may terminate this Agreement at any time by closing your account. We may suspend or terminate your access at any time, with or without cause or notice. Upon termination, your right to use the Service ceases immediately; sections that by their nature should survive will continue to apply.
15. Changes to the terms
We may update this Agreement from time to time. Material changes will be communicated by email or in-app notice. Continued use of the Service after the effective date constitutes acceptance of the revised terms.
16. Governing law and jurisdiction
This Agreement is governed by the substantive laws of Switzerland, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Exclusive jurisdiction for any dispute lies with the competent courts of Zug, Switzerland, subject to mandatory consumer protection rules in your country of residence.
